These Terms of Service (“Terms”) govern your access to and use of the MigrateYou website, application, and services (collectively, the “Service”) operated by MigrateYou Pty Ltd (ABN to be confirmed) (“MigrateYou”, “we”, “us”, or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Important Disclaimers

1.1 We Are Not a Migration Agent

MigrateYou is a technology platform that provides guided tools to help you prepare your Australian visa application. MigrateYou is not a registered migration agent under the Migration Agents Registration Authority (MARA) and does not provide immigration advice as defined by the Migration Act 1958 (Cth).

The Service provides general information and guided workflows to assist you in organising and preparing your own visa application. This is not a substitute for professional immigration advice.

1.2 No Guarantee of Visa Outcomes

We do not guarantee that any visa application prepared using the Service will be approved by the Australian Department of Home Affairs. Visa decisions are made solely by the Department at its discretion. MigrateYou has no influence over, and accepts no liability for, any visa decision.

1.3 Agent Review is Provided by Independent Agents

Where you purchase an Agent Review, the review is performed by an independent MARA-registered migration agent. That agent is not an employee, partner, or agent of MigrateYou. Any advice provided during an Agent Review is the professional opinion of that independent agent, and MigrateYou accepts no liability for the content, accuracy, or outcome of that advice.

Nothing on the Service constitutes legal advice. The information provided is of a general nature and may not apply to your specific circumstances. You should seek independent legal or migration advice where appropriate.

2. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

3. Account Registration

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your login credentials secure and confidential
  • Accept responsibility for all activity that occurs under your account
  • Notify us immediately of any unauthorised access to your account

We reserve the right to suspend or terminate your account if any information provided is inaccurate, incomplete, or fraudulent.

4. The Service

4.1 Description

The Service includes, but is not limited to:

  • Free visa pathway assessments and points estimates
  • Guided visa application workspaces with checklists and readiness scoring
  • Document generation tools (personal statements, supporting documents)
  • ImmiAccount lodgement guides
  • Optional MARA-registered agent review of your application
  • Optional agent lodgement on your behalf

4.2 Accuracy of Your Information

You are solely responsible for the accuracy and completeness of all information you provide through the Service. MigrateYou processes and organises the information you provide but does not independently verify it. Inaccurate or incomplete information may result in an incorrect assessment, a flawed application, or a visa refusal.

4.3 Changes to the Service

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

5. Fees and Payment

5.1 Pricing

The Service includes both free and paid features. Current pricing is:

  • Free Assessment - No charge
  • Application Pack - $199 AUD (one-time)
  • Agent Review - $299 AUD (one-time)
  • Agent Lodgement - $500 AUD (one-time, optional add-on to Agent Review)

All prices are in Australian Dollars (AUD) and include GST where applicable. We reserve the right to change pricing at any time, but changes will not affect purchases already completed.

5.2 Payment Processing

Payments are processed by Stripe, a third-party payment processor. By making a payment, you agree to Stripe’s terms of service. We do not store your full credit card details on our servers.

5.3 Refund Policy

If you are not satisfied with the Application Pack, you may request a full refund within 14 days of purchase, provided you have not already lodged a visa application using the materials generated by the Service.

Agent Review fees are refundable only if the review has not yet commenced. Once an agent has begun reviewing your application, the fee is non-refundable.

Agent Lodgement fees are non-refundable once the agent has submitted your application to ImmiAccount.

6. Intellectual Property

6.1 Our Property

The Service, including its design, text, graphics, logos, software, and all other content (excluding your data), is owned by MigrateYou or its licensors and is protected by Australian and international intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

6.2 Your Data

You retain ownership of all information and documents you upload to or create through the Service. By using the Service, you grant us a limited, non-exclusive licence to process, store, and display your data solely for the purpose of providing the Service to you.

6.3 Generated Materials

Documents, statements, and guides generated by the Service using your data are licensed to you for your personal use in connection with your visa application. You may not resell, redistribute, or commercially exploit generated materials.

7. User Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Provide false or misleading information in your visa application
  • Impersonate any person or entity
  • Attempt to gain unauthorised access to any part of the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Use automated means to access the Service without our written permission
  • Use the Service to facilitate visa fraud or any breach of Australian immigration law

8. Limitation of Liability

8.1 Exclusion of Warranties

To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • The results obtained from the Service will be accurate or reliable
  • Any information provided through the Service is complete or current
  • Your visa application will be approved

8.2 Limitation

To the maximum extent permitted by Australian Consumer Law, our total liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the total amount paid by you to MigrateYou in the 12 months preceding the claim.

8.3 Exclusion of Consequential Damages

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, or business
  • Loss of data
  • Visa refusal or delays
  • Costs of alternative immigration services
  • Emotional distress or inconvenience
  • Any other losses arising from your use of the Service

8.4 Australian Consumer Law

Nothing in these Terms is intended to exclude, restrict, or modify any rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable consumer protection legislation that cannot be excluded by agreement.

9. Indemnification

You agree to indemnify, defend, and hold harmless MigrateYou, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of the Service
  • Your breach of these Terms
  • The accuracy or completeness of information you provide
  • Your visa application or its outcome
  • Any dispute between you and an independent migration agent

10. Third-Party Services

The Service may integrate with or contain links to third-party services, including but not limited to Stripe (payments), Google/Firebase (data storage and authentication), and PostHog (analytics). Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the practices of any third party.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

12. Termination

12.1 By You

You may terminate your account at any time by contacting us at hello@migrateyou.com. Upon termination, your right to use the Service will cease immediately. You may request a copy of your data before termination.

12.2 By Us

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to, breach of these Terms, fraudulent activity, or conduct that we reasonably believe may harm MigrateYou or other users.

12.3 Effect of Termination

Upon termination, all licences granted to you under these Terms will immediately cease. Sections that by their nature should survive termination (including Sections 1, 6, 8, 9, 13, and 14) will survive.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of Victoria, Australia, for any dispute arising out of or in connection with these Terms.

14. General

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MigrateYou regarding the Service and supersede all prior agreements and understandings.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

14.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

14.5 Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service and updating the “Last updated” date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
